Congress Protecting Its Murderer Leaders

BSP MLA and former Uttar Pradesh Minister Anand Sen and two others were today sentenced to life imprisonment by a special court for murdering a dalit girl student four years ago. Although India civil society criticizes BSP for such leaders, but they never talk about the dirtiest criminal politicians in Congress or BJP.

Many of us are not aware of or have forgotten Sushil Sharma. In 2003 a Delhi court held former youth Congress leader Sushil Sharma guilty of killing his wife Naina Sahni and burning her body in the tandoor (oven) of Baghiya restaurant (Yatri Niwas Ashoak hotel) in the Capital on July 2, 1995. The court sentenced him to death in the murder case. The decision came eight years after the murder.

New Delhi, Sep 13 (PTI) Arguments today began in the Delhi High Court on the appeal filed by the Tandoor murder case convict Sushil Sharma against the capital punishment awarded to him with his counsel contending that there was no direct evidence linking him to the crime.

In the chargesheet, the prosecution had listed 99 witnesses but later it dropped 18 of them. However, the court recalled six witnesses taking the total number of prosecution witnesses to 87 apart from the six court witnesses. Over 450 dates were given in the case.

Since November 2003 A former Youth Congress leader, Sushil Sharma was convicted of murdering his wife Naina Sahni whom he suspected of infidelity. On July 2, 1995, he shot her with his licensed revolver, hacked the body to pieces and stuffed them into his Maruti car. According to police records, he drove to his restaurant at Ashok Yatri Nivas hotel and put the body pieces into a clay oven (tandoor) along with wood and butter to burn. He was arrested from Bangalore about a week later and charged with murder, criminal conspiracy and destruction of evidence. A city court convicted Sharma to death on November 7, 2003 after which he filed a review petition in Delhi high court. The appeal is now pending in the Supreme Court. Sharma has been lodged in Tihar Jail’s Jail 2 since 2004. Sources say he is a changed man now as he spends his days in jail performing pujas. He reportedly has idols of several Hindu gods and goddesses in his cell.

So, Mr. Sushil Sharama, a former Congress leader would ever be convicted like BSP leaders in four years is a big question that civil society and Congress should answer.

Another important thing is that who is saving him? Surely, the Congress.

Not only him, but Congress has a list of such leaders, the most dangerous criminals in the political history of independent India. And to the worst, Indian judiciary, seldom punishes such criminals and they continue to live their lives as leaders, ministers, businessmen and civil citizens of Indian society.

TANDOOR MURDER CASE: Sushil Sharma found guilty

A Delhi court on Monday held former youth Congress leader Sushil Sharma guilty of killing his wife Naina Sahni and burning her body in the tandoor (oven) of a restaurant in the Capital on July 2, 1995.

However, the court acquitted the other three accused jai Prakash Pehlwaan, Rishi Raj Rathi and Ram Prakash Sachdeva of charges of harbouring Sharma for want of evidence.

The court will hear arguments on sentence on Wednesday.

ASJ Thareja also directed the chief metropolitan magistrate to prosecute senior IAS officer D.K. Rao, the then resident commissioner of Gujarat Bhawan for allegedly harbouring Sharma after the gruesome murder.

Thareja also asked the Gujarat chief secretary to take appropriate administrative steps against the employees of Gujarat Bhawan in Delhi for "dereliction of duty".

According to the police, after the murder, Sharma had stayed with his IAS friend D.K. Rao at Gujarat Bhawan that particular night and fled to Jaipur the next day.

From there, Sharma went to Mumbai and later Chennai and got anticipatory bail. A police team led by Additional Commissioner of Police Maxwell Pereira flew to Chennai. But Sharma escaped to Bangalore, where he surrendered on July 10, 1995. Thereafter he was arrested and brought to Delhi.

According to the police, Sharma killed his wife as he had doubts over her fidelity. He believed Naina to be indulging in an affair with her classmate and fellow Congress worker Matloob Karim.

Sharma bashed Sahni up on many occasions, police alleged. Besides, while Sharma wanted to keep his marriage with Sahni a secret affair, she asked him to make it public.

On the night of July 2, 1995, Sharma, who reached his flat at Mandir Marg in the heart of the Capital, saw Sahni consuming liquor and talking to someone on the telephone.

She put down the receiver as soon as she saw him. Doubting that she was chatting with Karim, Sharma redialled the number, police alleged, adding his doubts were confirmed when Karim responded at the other end.

A furious Sharma took out his licensed revolver and fired three shots at Sahni. While one bullet pierced through her head, the other hit her in the neck. The third one missed her and hit an air conditioner.

Sahni died on the spot, police alleged. Sharma later took the body in his car to the Bagiya restaurant, where he and restaurant manager Keshav Kumar attempted to burn her in a tandoor there.

Police recovered Sharma’s revolver and blood-stained clothes and sent them to Lodhi Road forensic laboratory. They also took blood sample of Sahni's parents — Harbhajan Singh and Jaswant Kaur — and sent them to Hyderabad for a DNA test.

According to the lab report, "Blood sample preserved by the doctor while conducting the post mortem and the blood stains on two leads recovered from the skull and the neck of the body of deceased Naina are of 'B' blood group."

Confirming that the body was that of Sahni, the DNA report said, "The tests prove beyond any reasonable doubt that the charred body is that of Naina Sahni who is the biological offspring of Mr Harbhajan Singh and Jaswant Kaur."

Evidence insufficient against Sushil Sharma in tandoor case

New Delhi, Sep 13 (PTI) Arguments today began in the Delhi High Court on the appeal filed by the Tandoor murder case convict Sushil Sharma against the capital punishment awarded to him with his counsel contending that there was no direct evidence linking him to the crime.

Commencing his arguments on appeal against Aditional Sessions Judge (retired) G P Thareja's order holding him guilty of murder of his live-in partner Naina Sahni, Sharma's counsel K K Sood submitted before the court that there were only circumstantial evidence in this case and the same were insufficient to prove the guilt of the convict.

"There was only circumstantial evidence and no eye witness account of the crime is on record. The chain between the crime and the culprit has not been proved beyond reasonable doubt. The trial court has erred in holding him guilty of the murder," Sood told a Bench comprising Justice T S Thakur and Justice J P Singh.

A Delhi court on Friday sentenced former Youth Congress leader Sushil Sharma to death in the Naina Sahni murder case.

Additional Sessions Judge G.P. Thareja sentenced his accomplice Keshav Kumar to seven years rigorous imprisonment for conspiring with Sharma to burn Sahni's body in the tandoor of Baghiya restaurant at the ITDC-owned Ashok Yatri Niwas in the heart of the Capital.

The court ordered that Sharma be "hanged by the neck till dead".

Sharma was also sentenced for the offence under Section 120 (B) (Conspiracy) read with Section 201 (Destruction of evidence) of IPC to seven years rigorous imprisonment with a fine of Rs 10,000.

A fine of Rs 10,000 was also imposed on Keshav, who was found guilty of conspiring with Sharma to destroy the evidence in the case.

The court directed that the file of the case be sent to Delhi High Court for confirming the death sentence imposed on Sharma.

The court on Monday had convicted Sharma for murdering his wife Naina Sahni, suspecting her fidelity, and later burning her body in a tandoor (oven) of a restaurant in Delhi over eight years ago.

The court had held Sharma and Keshav, who was then manager of the restaurant guilty for conspiring to cause disappearance of the evidence of murder.

Keshav had assisted Sharma to dispose of Sahni's body in a tandoor there.

However, the court had acquitted him of charges under Section 302 (Murder), saying it was not proved.

The other three accused in the case - Jai Prakash Pehlwaan, Rishi Raj Rathi and Ram Prakash Sachdeva — were acquitted of the charges of harboring the accused.

Tandoor murder case: SC passes stay order on Sushil Sharma's death sentence

The Supreme Court recently passed a stay order on the capital punishment of Sushil Sharma, the main accused in the infamous 1995 Tandoor murder case. The apex bench, consisting Justices S B Sinha and Markandey Katju, referred the case after admitting Sharma’s plea, to a larger bench of three judges for further hearing.

A petition was filed by Sharma in the apex court challenging the order of the Delhi High Court defending the decision of a lower Court and confirming his capital punishment.

On July 2, 1995, Sharma, an ex- leader of Youth Congress, shot his wife Naina Sahani at point blank range and disposed off her body in a tandoor. The second accused called Keshav Kumar, the owner of the Bagia restaurant, who had helped Sharma to dispose the body, was sent to jail for seven years, which has already been served by him.
